1. Service Description

Motero ("the Service") is an AI-powered motorcycle route planning platform operated by Lubalab, Milan, Italy. The Service enables users to plan motorcycle routes, analyze road conditions using artificial intelligence and Google Street View imagery, and discover popular riding roads across Europe.

2. Account Registration and Responsibilities

To access certain features, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

3. Credit System and Payments

Motero operates on a credit-based system. Credits are required to perform AI road analysis on route segments.

  • Credits are purchased through the platform via Stripe, our third-party payment processor
  • Credits are non-refundable once purchased
  • Credits do not expire while your account remains active
  • Credits are non-transferable between accounts
  • Prices are displayed inclusive of applicable taxes

All payment processing is handled by Stripe. By making a purchase, you also agree to Stripe's terms of service.

4. AI Analysis Disclaimer

Important: The AI-powered road analysis provided by Motero is for informational purposes only and is not a substitute for your own judgment as a rider.

  • Road conditions change over time — analysis is based on imagery that may not reflect current conditions
  • The AI may produce inaccurate assessments of road surface quality, hazards, or conditions
  • Weather, seasonal changes, construction, and other factors can alter road conditions at any time
  • Always exercise caution, ride within your skill level, and assess road conditions in real time

You acknowledge that Motero's analysis is a planning aid and accept full responsibility for your riding decisions.

5. Street View Imagery

The Service uses Google Street View imagery to perform road analysis. All Street View imagery is the property of Google LLC and is used in accordance with the Google Maps Platform Terms of Service. You may not download, copy, or redistribute Street View imagery obtained through the Service.

6. User-Generated Content

Routes you create and analyses you perform are associated with your account. By using the Service, you grant Motero a non-exclusive, worldwide license to use anonymized and aggregated data derived from your routes (such as road quality ratings) to improve the Service and generate community features like the heatmap. Your specific route details remain private unless you choose to share them.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Motero is provided "as is" without warranties of any kind, express or implied
  • We are not responsible for road conditions, accidents, injuries, or damages that occur during or as a result of any ride planned using the Service
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim

Motorcycle riding is inherently dangerous. You assume all risks associated with riding, regardless of any information provided by the Service.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or abuse the API
  • Circumvent the credit system or any usage limits
  • Interfere with the Service's infrastructure or other users' access

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time through your profile settings. Upon termination, unused credits are forfeited and your data will be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.
